The following is a portion of the transcript taken during the January 23, 2023 hearing in which the Judge accepted the negotiated plea entered by Ricardo Rodriguez Rodriguez and imposed the agreed upon sentence.
During the hearing, after Ricardo had agreed to the plea and before the Judge imposed the sentence, Catherine was allowed the opportunity to address the court, and Ricardo, with a victim impact statement. The following is that statement.
WITNESS CACCAMO: Good morning
THE COURT: Good afternoon.
WITNESS CACCAMO: Good afternoon. My name is Catherine Caccamo. I am the ex-wife of Ricardo Rodriguez. I have spoken with my daughter ██████████. We have a couple of things that we compiled that we would like to share with you guys today.
This man that appears in court today has affected my family's hearts in a way that no one can imagine. With the fear that surrounds me day after day, let me tell you, PTSD is no joke. I am tormented by the way that he treated me, like I was less than him and the thought of what ██████████ endured.
It is very difficult to put on a brave face for my kids and be strong for them, especially when I see them crying because I too am still suffering and traumatized from what he did to our family. I feel like I should be able to protect ██████████ because a parent should always be able to protect their child.
I feel a deep sense of shame because I was unable to protect her and keep her safe. My kids are the most important thing in the world to me. To see how ██████████ lost so much of herself since he started this hurts me in ways that I cannot describe with words. She was happy. She was friendly. She was outgoing and silly. I watched her wither into a sad, reclusive girl after he purposely drove a wedge between us.
I now understand her actions and feel ashamed for the way I tried to parent her, thinking I was doing the right thing, but all I did was cause a greater divide. Because of her (inaudible), I was constantly her competition. What he did was wrong. I hope that he feels the fear that I did. He will never understand how much he changed my life and made my family feel unsafe in our own community.
I truly hope it learns from this because he has taken so much from us. Everyone here, including God, can now see how (inaudible) of a person you are. You took away our reputation. You took away our confidence. You took away our dignity. You took away her innocence. You took advantage of everyone, as narcissists typically do. You embarrassed yourself and your family.
I did have a question that I know I’ll never get the answer to. But what am I supposed to tell our daughter when she grows up? I'm so sorry, honey, but your father chose to fulfill his own selfish needs and not think about you a single time? ██████████ is the most beautiful, wonderful, bright and intelligent child. And you will miss every second of that. She is loved beyond measure. ██████████ is my best friend. He’s so witty and fun. He’s so confused and has the hardest time leaving his family because of the choices you made.
As for ██████████, I can't really speak for her. I love her so much and had to let her go. Do you know how that feels to have half of your family disappear and have to keep going, running a business, working full time, while you lay on your cot and pity yourself? How do you think that made your children feel? Your selfish ways, Ricardo, will never be matched.
You drained me for every dime I had. I spent everything I had on you because I believed in you. I was only a pawn in part of your plan, and I should have seen that from the start. You blamed me not wanting to have sex with you after our daughter was born, to rationalize you repeatedly raping a little girl.
MR. DeTARDO: Judge, at this point -
WITNESS CACCAMO: I would like to continue.
THE COURT: Hang on. Hang on.
MR. DeTARDO: I understand that there is a right to make a statement in regards to the impact on the victim. To the extent that Ms. Catherine here feels victimized by some other acts, I would ask that she keep her presentation limited to the crimes that my client’s pleading to and not to other issues that they had in the marriage, unrelated to the crimes that he’s pleading guilty to.
MS. BATEMAN: Your Honor -
THE COURT: What do you say about that, Ms. Bateman?
MS. BATEMAN: Speaking to Mr. Rodriguez, she doesn’t have very much left in her statement. I feel that she has a right to read her statement as a victim in all of this, how it’s impacted their lives.
THE COURT: Overruled.
WITNESS CACCAMO: Thank you, sir.
You fall right into every stereotype that you hated. And the family that is here backing you has chosen not to be part of our lives, and I am thankful for that. For anyone who would stand behind you shouldn’t breathe the air of my daughter. Supporting you makes them makes them no better than you.
Thankfully, I and my children are supported and loved unconditionally. I would like to thank you for a few things: Thank you for my daughter. She is my everything. Without her, I would not be here today. Knowing she needed me was the only thing that kept me alive, even when I didn’t want to be. Thank you for freeing me because I've now found the best partner in the world who loves my children, (inaudible) every mess that you left behind.
Thank you for letting me fall flat on my face because now I'm more successful than you could ever imagine. The comeback is always better. Thank you for making yourself so far away from my family. I will never have to worry that you can throw another plate of food at me or raise your fist back at me in a cowardly display of your ideals of masculinity. Thank you for stealing my truck and driving to Alabama to eat your Burger King like nothing happened because the ride back was liberating. That was the moment I knew I could do more than you ever gave me credit for. We have made it without you.
